Minutes – October 21, 2008

PUBLIC HEARING
08.05 – Carolynn Abraham – area variance, replacement of structure in Canadarago Lakeshore protection area – 220 Bibik Road (#52.11-1-37.00)
Chairman Greg Crowell opened the public hearing at 7:07 PM, explaining the process, and asking if anyone from the public had any questions or comments about the Carolynn Abraham application.  Hans DeWaal, who lives near Canadarago Lake, said he thought that the project was a very good idea, restoring a building and moving it further from the Lake and neighbors.  At 7:26, Crowell closed the public hearing.

 REGULAR MEETING
The monthly Town of Otsego Zoning Board of Appeals (ZBA) meeting was held on this date.  Chairman Greg Crowell called the meeting to order at 7:10 PM and roll call was taken by Secretary Bill Deane.  Board members present were Crowell, Tony Scalici (Vice-Chairman), and Bill Kitchen.  Sam Hoskins was absent.

Chairman Crowell asked if anyone had a potential conflict with tonight’s applicants.  No one reported any conflict.

Scalici moved to approve the ZBA minutes of September 16 as written.  Kitchen seconded the motion and it was approved, 3-0.

Chairman Crowell passed around correspondence received since the last meeting: the September/October 2008 issue of Talk of the Towns&Topics; the September/October 2008 issue of Rural Futures; and a flier on a training seminar, “Zoning, Subdivision, and Land Development Law,” to be held in Syracuse on October 28.

The board moved on to applications.

APPLICATIONS
08.05 – Carolynn Abraham – area variance, replacement of structure in Canadarago Lakeshore protection area – 220 Bibik Road (#52.11-1-37.00)
Representative Rob Nixon and builder Wayne Smith were present.  The Board reviewed the application and supporting documents in the file, including new documents submitted at the request of the Planning Board.  It was noted that the deck would be 32’2” from the Lake.  Nixon and Smith said the building would stand about 25 feet high, well within the height limit.

Tony Scalici moved to approve the variances sought: 21’8” on the north side, 13’4” on the south side, and 67’10” from Land Use Law 4.04 (restricting construction in the shoreline protection area).  Scalici noted that the dimensions are an improvement over the existing building in two of the three locations for which variances are sought; that there will be no increase in usage of the new building as compared with the existing one; and that the project conforms with other improvements in the Canadarago Lake district.  Chairman Crowell seconded the motion and it was approved, 3-0.

08.06 – John & Anne Hart – area variance, replacement of structure in Canadarago Lakeshore protection area – 207 Marble Road (#52.08-1-17.00)
Applicant John Hart and engineer Hans DeWaal were present.  Hart wants to replace a structure on the east side of Canadarago Lake.  The new building would require variances of 20 feet on the north side, 17 feet on the south side, 38 feet on the east (front) side, and 47 feet from the restriction of building in the shoreline protection area.  The Board reviewed the application and supporting documents, including photographs of the property and neighboring properties.

Tony Scalici moved to deem the application complete and schedule a public hearing for November 18.  Chairman Crowell seconded the motion and it was approved, 3-0.

With no further business, at 7:39 Chairman Crowell adjourned the meeting.
