Minutes - October 18, 2005

The monthly Town of Otsego Zoning Board of Appeals (ZBA) meeting was held on this date. Vice-Chairman Greg Crowell called the public hearings to order at 7:37
PM.

PUBLIC HEARINGS

05.11 - Cooperstown Central School - Interpretation, notice of violation, public parking lot - Linden Avenue, Cooperstown (#131.00-1-16.02)

No one from the public was in attendance. Vice-Chairman Crowell announced that the Town had received a letter (filed) from Village of Cooperstown Attorney John
Lambert, dated October 17, requesting adjournment of tonight's public hearing on this application. Lambert wrote that he had been in contact with Town Attorney Margaret
McGown and hopes to settle the matter without ZBA intervention, but wants to be put on the ZBA's November 15 meeting agenda. Bill Deane asked whether he would have to send
out notices and an advertisement again next month. Crowell said he thought so.

05.10 - David Wilshere - Area variance, construction of new garage - Curry Road, Hartwick (#112.00-1-27.10)

No one was in attendance except the applicants. Sam Hoskins moved to close the public hearing. Joe Potrikus seconded the motion and it was approved, 3-0.

REGULAR MEETING

Acting Chairman Crowell called the regular meeting to order at 7:40 PM. ZBA Secretary Bill Deane took roll call. Present were Crowell, Sam Hoskins, and Joe
Potrikus. Also present was Zoning Enforcement Officer Sal Furnari. Chairman Anthony Scalici was absent, and Jim Ferrari arrived just as the meeting was being adjourned.

The Board reviewed the minutes of the September 20, 2005 meeting, mailed to the members. Sam Hoskins moved to approve the minutes as written. Joe Potrikus
seconded the motion and it was approved, 3-0.

Other than the aforementioned letter from John Lambert, the only "correspondence" consisted of copies of the revised (September 14, 2005) Land Use Law,
distributed to members. Bill Deane pointed out that among the revisions (summarized on the last page) was clarification of the shoreline protection law, discussed in
previous meetings. The Board moved on to the applications.

APPLICATIONS

05.11 - Cooperstown Central School - Interpretation, notice of violation, public parking lot - Linden Avenue, Cooperstown (#131.00-1-16.02)

As previously mentioned, action on this application was postponed.

05.10 - David Wilshere - Area variance, construction of new garage - Curry Road, Hartwick (#112.00-1-27.10)

Mr. and Mrs. David Wilshere were present. The Board briefly reviewed their application, which requests a 12-foot side-yard variance on the south side of the
property.

Sam Hoskins moved to grant the variance, saying that no undesirable change would be produced in the character of the neighborhood (and, in fact, the project
mirrors the adjoining property); that the benefit sought could not feasibly be achieved by any other means; and that, although the variance was substantial, it will have
minimal impact on the neighborhood. Acting Chairman Crowell added that the project was in keeping with the character of the neighborhood. Joe Potrikus seconded the motion
and it was approved, 3-0.

David Wilshere submitted $50 cash (delivered to the Town Clerk), in payment for his ZBA Application ($25) and land use permit ($25) fees.

With no other business, at 7:51 Joe Potrikus moved to adjourn the meeting. Sam Hoskins seconded the motion and it was approved, 3-0.
